The agreement between your organization and Errorgap (a Georgia LLC; legal entity name being finalized) for use of the service. Placeholder structure for counsel review — section order is final; binding language is not.
01Introduction & acceptance
By creating an account, clicking to accept, or using the service, you agree to these Terms on behalf of your organization. Acceptance is recorded with version, timestamp, IP, and user agent (see clickwrap).
02Service description
Errorgap is a hosted incident-intelligence platform that ingests and correlates production telemetry. Features, limits, and availability are described on the marketing site and in the docs.
03Accounts & users
You are responsible for your users, their credentials, and the actions taken under your organization, including scoped agent tokens you issue.
04Customer data & service data
You retain ownership of the telemetry you send. You grant us the limited rights needed to operate the service. We process service data on your instructions as described in the Privacy Policy and DPA.
- You own and control your service data.
- We use it only to provide and secure the service.
- A Data Processing Addendum is available on request.
05Restrictions & acceptable use
You may not misuse the service. Sending regulated data (PHI, full card numbers) and the other prohibitions in the Acceptable Use Policy are forbidden.
06Billing, renewals & cancellation
Paid plans bill in advance on a recurring cycle and renew automatically until cancelled. Cancellation stops the next renewal; fees already paid are non-refundable except where required by law.
07Suspension & termination
We may suspend for non-payment or material breach. On termination you may export your data during a grace period, after which it is deleted per the retention schedule.
08Warranties, disclaimers & liability
The service is provided on an "as is" basis except as expressly stated. Liability is limited as set out here; nothing limits liability that cannot be limited by law.
09Governing law & notices
These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws rules. The parties submit to the exclusive jurisdiction of the state and federal courts located in Georgia.
